1. ACCEPTANCE OF TERMS

Welcome to Mixwell Pharmacy: Compounding Solutions ("Mixwell Pharmacy," "we," "us," or "our"). By accessing or using our website at www.mixwellpharmacy.com, placing orders, or using our services, you agree to be bound by these Terms of Service. If you do not agree to these terms, including the mandatory arbitration and no-refund policies, please do not use our services.

2. ABOUT OUR SERVICES (FDA 503A COMPLIANCE)

Mixwell Pharmacy is a licensed compounding pharmacy operating under Section 503A of the Federal Food, Drug, and Cosmetic Act. We provide custom-compounded medications prepared specifically for individual patients based on a valid prescription from a licensed healthcare practitioner. Our services include:

  • Multi-specialty compounding (BHRT, veterinary, pediatric, dermatology, etc.).

  • Pharmaceutical consultation services.

  • OTC supplements and wellness products.

3. PRESCRIPTION MEDICATIONS

3.1 Valid Prescription Requirement: All prescription medications require a valid, patient-specific prescription from a licensed healthcare provider. We reserve the right to verify prescriptions with the prescribing practitioner before dispensing. 3.2 Nature of Compounded Medications: You acknowledge and agree that:

  • Not FDA Approved: Compounded medications are not approved by the FDA. The FDA does not verify the safety or effectiveness of compounded drugs.

  • Beyond-Use Dates (BUD): You must strictly adhere to the "Do Not Use Beyond" date on the label. Compounded products have different stability profiles than mass-manufactured drugs.

  • Variability: Custom formulations may vary slightly in appearance (color/texture) between batches. 3.3 No Returns/Refunds: Due to federal and state law (California Business and Professions Code), prescription medications cannot be returned, exchanged, or refunded once they have left the pharmacy. All sales are final.

4. SHIPPING, DELIVERY, AND "COLD CHAIN" POLICY

4.1 Service Areas: We ship only to jurisdictions where we are licensed. Orders for unlicensed states will be cancelled. 4.2 Temperature-Sensitive Medications:

  • Our Responsibility: We ship refrigerated items in insulated packaging with ice packs designed to maintain stability for the transit window. It is normal for ice packs to be melted upon arrival; this does not indicate spoilage.

  • Your Responsibility: You must monitor tracking and ensure someone is available to retrieve and refrigerate the package immediately. 4.3 Risk of Loss: Title and risk of loss pass to you upon our delivery to the carrier (FedEx/UPS/USPS). Mixwell Pharmacy is not liable for "porch piracy" or theft after a successful delivery scan.

5. PRIVACY AND HIPAA COMPLIANCE

5.1 Data Separation: Mixwell Pharmacy utilizes a separate, HIPAA-compliant secure portal for the collection and storage of all Protected Health Information (PHI). 5.2 Shopify Limitation: No PHI is stored on this website (Shopify). By using this site, you acknowledge that only basic order information (Name, Shipping Address) is processed via Shopify, while your clinical and prescription data are secured in our independent pharmacy management system.

6. MANDATORY PHARMACIST CONSULTATION (CALIFORNIA)

Pursuant to California Code of Regulations § 1707.2, you have the right to a consultation with a licensed pharmacist for every prescription.

  • To Request a Consultation: Call +1 (909) 378-7301 or reply to your order confirmation with "CONSULTATION REQUEST."

  • Documentation: By placing an order, you acknowledge that you have been offered the opportunity to consult with a pharmacist.

7. MEDICAL DISCLAIMER

7.1 Not Medical Advice: Information on this website is for informational purposes only. Use of this site does not create a doctor-patient relationship. 7.2 Prescriber Reliance: Mixwell Pharmacy relies entirely on the clinical judgment of your prescribing physician. We assume no liability for the appropriateness of the treatment protocol selected by your doctor.

8. LIMITATION OF LIABILITY

To the fullest extent permitted by law:

  • Our total liability for any claim shall not exceed the amount you paid for the specific product giving rise to the claim.

  • We are not liable for adverse reactions to custom formulations when prepared according to the prescriber’s instructions.

  • We are not liable for shipping delays caused by carrier issues or "Acts of God."

9. PROHIBITED USES

You agree not to use our services for any unlawful purpose, including attempting to obtain medications without a valid prescription or impersonating a healthcare provider.

10. DISPUTE RESOLUTION

10.1 Governing Law: These Terms are governed by the laws of the State of California. 10.2 Venue: Any legal action must be filed in the state or federal courts located in San Bernardino County, California. 10.3 Informal Resolution: You agree to contact us to attempt to resolve any dispute informally for at least 30 days before filing any legal claim.
